To be eligible, an applicant must have received correspondence from the Royal Commission calling them, or granting leave to appear, as a witness at a public or private hearing; granting leave to attend a private session where legal representatives are authorised to be present; requesting attendance at an interview; requesting a written statement to be used as evidence; or requiring compliance with a notice to produce. The department may seek advice from the Office of the Royal Commission to determine eligibility. If an organisation has been called by the Royal Commission, it will be assessed to determine whether it can meet the cost of legal representation without incurring serious financial difficulty. Applicants called in their personal capacity are exempt from an assessment of financial circumstances. Applicants should exhaust other options for legal assistance before applying, and if eligible for another form of assistance they will generally not be eligible under this scheme.
